Trademark Usage Policy

Effective date: August 1, 2025

  1. Introduction

Ecoflex’s intent with this Trademark Usage Policy (“Policy”) is not to limit commercial activity around Ecoflex family of companies. Please note that undefined capitalized terms used in this Policy shall have the meanings ascribed to them in the Terms of Service and any relevant agreement, policy, or addendum incorporated by reference therein.

  1. Intent of this Policy

Ecoflex owns and oversees the trademarks for the Ecoflex name, products, logos, and other intellectual properties (collectively, the “Ecoflex Marks”). We developed this Policy to:

  1. Provide guidelines for those who would like to use the Ecoflex Marks;
  2. Clearly define how Ecoflex-related businesses and projects can and cannot use Ecoflex Marks; and
  3. Prevent/discourage anyone from using the Ecoflex Marks to unfairly profit from, trick, or confuse people looking for official Ecoflex products and/or services.

As such, you will need permission from Ecoflex to use any Ecoflex Marks if you intend to use the Ecoflex Marks in a manner that is not specifically stated in this Policy. Additionally, if we determine that your use of the Ecoflex Marks is in violation of this Policy, our Terms of Service, or any other relevant agreement, policy, or addendum you are subject to, we can revoke your right to use the Ecoflex Marks at any time.

  1. Prohibited Uses of the Ecoflex Marks

Unless you have our explicit permission, you are expressly prohibited from:

  1. Combining any of the Ecoflex Marks with your company name, your product, your marks, or incorporate any of the Ecoflex Marks into your logo;
  2. Using a logo, company name, domain name, or mark that is confusingly similar to the Ecoflex Marks;
  3. Registering the Ecoflex Marks or derivative words or phrases as part of a domain name;
  4. Changing the color of our logo; photoshop or otherwise modify our logos; add words directly around the logos; or overlap our logo with shapes or photos; 
  5. Using phrases such as “Ecoflex Partner,” “Ecoflex Expert,” or “Ecoflex Certified”; or
  6. Using old versions of the Ecoflex Marks.
  1. Permitted Uses of the Ecoflex Marks

You may use the Ecoflex Marks in a referential phrase to refer to and explain your product offerings, so long as the use does not suggest an affiliation with or an endorsement by Ecoflex. Your use of any Ecoflex Mark must only be referential and less prominent than your own business name or brand.

For example, an IBC distribution company named Very Cool Containers may describe its business as “Very Cool Containers, offering Ecoflex anti-static IBCs, parts, and reconditioning services.” However, that same company cannot name its business “The Ecoflex Container Company.”

Similarly, a business that provides Ecoflex templates named Very Cool Templates may describe itself as “Very Cool Templates, creators of Ecoflex templates,” but cannot call itself “The Ecoflex Template Company.”

  1. Advertising Rules and Restrictions

You cannot use the Ecoflex Marks in any keyword targeting via AdSense/AdWords or similar products.

You may be able to use the Ecoflex Marks in the text of advertising provided that you are just referring to our products or your services and it is clear that you are not authorized, affiliated, or otherwise endorsed by Ecoflex. For example, you cannot run advertisements that include text such as “the Ecoflex Distributor,” “the Ecoflex Experts,” “Ecoflex approved.” However, you are permitted to run advertisements that include text such as, “ABC IBC Containers, we build with Ecoflex” since customers would not be confused as to your relationship with Ecoflex.

When you display the Ecoflex Marks or the Ecoflex product in demonstrations, webinars, or your materials, you must include disclaimers such as: “This webinar is independent of Ecoflex Manufacturing LLC., Ecoflex Reconditioning Services, or Ecoflex Inc., and is not authorized by, endorsed by, sponsored by, affiliated with, or otherwise approved by Ecoflex, LLC.”

  1. Requesting Permission to Use the Ecoflex Marks

If you would like to use the Ecoflex Marks in a manner that is prohibited or not provided for in this policy, please email Contact@ecoflex-mfg.com to seek permission from our team. Please contact us for clarification if there is any doubt.

  1. Violations of this Policy

Ecoflex, in our sole discretion, may permanently or temporarily terminate, downgrade, suspend, or prohibit your access to the Ecoflex Platform without prior notice and liability if you violate any provision of this Policy.
